INTRODUCTION

Cantor Realty Corp. Brokerage herein referred to as (the “Brokerage”) and www.cantorrealty.com herein referred to as (the “Website”) are committed to protecting personal information in its possession. This Privacy Policy (the “Policy”) has been developed to explain how the Brokerage treats the personal information it collects for the Brokerage and on behalf of a third party, herein referred to as (the “Third Party”), and to detail its responsibilities under the Personal Information Protection and Electronic Documents Act (“PIPEDA”).

WHAT IS PIPEDA?

PIPEDA is federal legislation that governs the collection use and disclosure of personal information in a manner that respects your right of privacy concerning your personal information.  PIPEDA balances these rights against an organization’s need to collect, use and disclose personal information for purposes that a reasonable person would consider appropriate in the circumstances.

WHAT IS PERSONAL INFORMATION?

Personal information is information about an identifiable individual or entity. Examples of personal information include: gender, date of birth, drivers license number, current and previous home address, phone number, family status, credit score, names of former landlords, social insurance number, income, the name of your employer and other employment details, names of family members, and monthly rent.

WHAT DOES THIS POLICY ENCOMPASS?

This Policy describes how the Brokerage complies with PIPEDA including the purposes for which information is collected, used and disclosed, the Brokerage’s treatment of personal information and your rights concerning your personal information. It is organized based on the principles listed in the Canadian Standards Association’s Model Code found in Schedule II to PIPEDA, under which the Brokerage’s privacy responsibilities are organized.

IDENTIFYING PURPOSES

Credit Checks. Personal information is collected for the purpose of the Brokerage or a Third Party (for example, a landlord) conducting a credit check on individuals or entities. The credit check is a risk assessment tool used to ensure that a tenant will be able to make the monthly payments required to lease a premises. Consent to collect personal information for the purpose of conducting a credit check are typically requested at the time of submitting an offer to lease or it can be a condition of the offer to lease. Any refusal to provide consent for information and disclosure to the Brokerage or Third Party for the purposes of conducting a credit check could be potential grounds for a Third Party to refuse tenancy. The Brokerage or Third Party will retain the results of a credit check.

FINTRAC. The Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) is Canada’s financial intelligence unit. Its mandate is to facilitate the detection, prevention and deterrence of money laundering and the financing of terrorist activities, while ensuring the protection of personal information under its control. Personal information is collected for the purpose of the Brokerage identifying an individual or entity which is purchasing or selling real estate through the Brokerage. As per the Real Estate and Business Brokers Act, 2002 (REBBA), the statute that governs the conduct of real estate professionals in Ontario for the protection of consumers, the Brokerage is obligated to confirm and properly identify all individuals or entities when the Brokerage is representing a purchaser or seller. Consent to collect personal information for the purpose of the Brokerage complying with its FINTRAC and REEBA obligations are typically requested at the time when an agreement of purchase and sale (or similar document) has been mutually executed by both parties involved in the transaction. Information contained in this Website is intended solely to provide general guidance on matters of interest for the personal use of the reader, who accepts full responsibility for its use. Information Collected By The Brokerage’s Website. The Brokerage collects information about users during their participation in certain activities on the Website.  All information provided by users of this Website or emailed to the Brokerage is collected for the purpose of better serving the user’s real estate needs. The user can request by phone or email, that the Brokerage’s office alter their information.   

When users request pages from our web server, our server automatically collects some information about the users, including Internet protocol (IP) addresses. As you browse the Website, the Brokerage collects information about your visit and not about you personally, via web server logs and browser cookie files.

The Brokerage monitors statistics such as:

• How many people visit the Website.

• Which pages users access or visit on the Website.

• From which domains visitors come (for example, “google.com” or “yahoo.com”).

• Which browsers people use to visit the Website site.

While the Brokerage gathers this information, none of it is associated with you as an individual or entity.  The Brokerage uses these statistics to improve its Website, monitor its performance, and to more easily navigate the Website which will provide better service when users return to the Website.

Information Collected By The Brokerage’s Marketing Emails. The Brokerage does collect more specific information about users who have been registered for the Brokerage’s automated email subscription whether it be by express or implied consent, such as the following:

• A user’s email address.

• A user’s First and Last Name.

• A user’s Telephone Number.

• A user’s Work Address.

• A user’s Work Position.

• How many and which specific user’s click specific links in the Brokerage’s automated email and visit the Website.

Information obtained via the Website and the Brokerages automated email subscription are strictly used by the Brokerage. Should you not wish to receive emails from the Brokerage’s automated email subscription, you may opt out at any time by clicking the “unsubscribe” link at the bottom of the email. Should you choose to no longer receive any correspondence whatsoever from the Brokerage, kindly email david@cantorrealty.com and write in the Subject Line, “I no longer wish to receive any further correspondence from Cantor Realty Corp. Brokerage.”

LIMITING USE, DISCLOSURE AND RETENTION

The Brokerage only uses and discloses information for the purposes for which, it was collected, or otherwise in accordance with PIPEDA. By providing the personal information on our Website or in response to our Marketing emails, we assume your consent to our collecting such information and using such information for the specific purposes set out in this policy. Any new purpose for which the information is to be used or disclosed shall be documented, and consent will be obtained for it.

Unless this Policy indicates otherwise, the Brokerage retains personal information for a minimum period of Seven (7) years. Personal information will be disposed of by shredding or otherwise destroying it. Third party services may be retained to destroy personal information; however, that third party will be required to enter into a confidentiality agreement with the Brokerage in order to protect the personal information.

GENERAL

The Brokerage is not responsible, nor can it provide any warranty about the accuracy or source of the information and privacy policies of other websites, for other business’s and organizations, to which it may provide links.
